Johnson said something very important on Bloomberg TV, he said that more
NBA Basketball Players need to go out and start more businesses across
America to hire more workers and help decrease the high employment
within our communities if our economy is going to recover. All of us
need to pitch in because our country is going through one of its worst
times
in history. He is the author of a new book called: "32 WAYS TO BE A CHAMPION IN BUSINESS": Magic
Johnson is a role model to idolize because, he is not only one of
the best basketball players in history to me, and because I think he's genuine and
keeps it real. He has gone into different neighborhoods across the
country and has made a dent within the high employment that many of us face on
a day to day basics. Many people look at many NBA players as role models and
many are not. Most are just plain ball players and nothing else. Dr Martin
Luther King said it best; "Judge A Man By The Content of His Character"
and Not by The Color of Their Skin" ! Magic has achieved winning the NBA
Playoffs on and off of the court. We need more Ervin Magic Johnsons in
this world who realize that you can't take the money with you when you
die so do the right thing with it , while your still alive. I hope other NBA Super Stars wake up and realize what Magic has
done and try their best to revitalize their neighborhood with new jobs
and sprinkle some hope more hope around in the future ! RIGHT ON MAGIC,

a long time ago ? You can't take it with you.
First thing I want to say is I love my country The USA and I want to
say that. " I DO NOT CONDONE DRUGS IN ANY SHAPE OR
FORM NOR DO I APPROVE ANYONE TAKING THEM " ! Their are many assumptions that you can make when it comes down to
changing the world for the better between what is good and what is bad.
I'am 54 year's old and remember when " The War On Drugs " first begin back in the 1970's.
Now here
we are almost thirty eight year's later and the war on drugs " HAS
NOT WORKED
", or has really made a positive or a sufficient difference within our communities quality of life
and I can personally say that the USA and the world is in worst shape
now with more drugs then when the drug war first started back during the 1970's that is the
truth. Also many of the people in power throughout the corporate and
throughout the USA in major positions today might have been getting high
when they were young back in high school or college, so who better to look at,
update
and make new changes to drug laws that do not fit into days world even
if they felt the laws were all wrong.
EXAMPLE
NYS Governor David Patterson stated when he gave his State of The State
January 2009 Speech said, he would look into reforming " The NYS
Rockefeller Drug Laws. This is something that should have been talked
about year's ago. What has inadvertently happened was that a form of new
slavery has emerged being that so many young adults across America have
been locked up. The
prison corrections department throughout the USA needs to get rid of the name
corrections, for example the NYS Corrections System needs to change its
name to The NYS Warehousing
Jail System, let's start calling it, exactly what it is !

I live in Brooklyn N.Y USA where most young African and Hispanic
Americans either play Basketball, Football or Baseball. The drug laws
that need changing are basically needed to reorganize the inner cities [
Example The NYC Five Boroughs] and really do not affect rural or
suburban community areas in the same way why. In rural and suburban
communities most people do not hang out on street corners as people do
who live within urban inner city communities plus rural and suburban
community area laws are better enforced. As you know Basketball, Football or Baseball
Athletic Sports entail running skills and when the cops try to apprehend
known young drug dealers to arrest and remove them off the street it becomes an olympic
sprint race most of the time to see if the cops can catch them. Many youth can sprint off at 10
- 15 miles or more an hour like a full grown Elk. I once saw on the TV
show called Cops, a Police were trying to catch this young African
American man. The Police Officer walked up to the young man and said hey son, and the
sprinting race was on.
I could not believe the speed this young man took
off with I say he'd even give Mr Lighting Bolt the man from the Jamaica West
Indies Island who is now the fastest man in the world a run for his
money. My jaw dropped when this young man while running leaped on top
of, it seamed like an eight foot wall and made it with one leap, he did
not trip and while still
standing straight up. P-uuuuuu homey was gone running through the bushes
on top of the eight foot wall, talk about miracles. He definitely left
the Police Officers chasing him behind in the dust and had theirs as well as my
mouth, left wide open too and I was sitting home on the couch, and not
even chasing after him. [Smile]

I wrote
this article to start people thinking and talking about how we can
revamp a broken legal system against drugs that does not effectively
work, and has turned into a form of legal slavery especially against
male African and
Hispanic Americans and
continues to mainly reduce the African and Hispanic male youth
population in great numbers. If legalizing drugs is not the answer ?
Then what is the answer, and that is why we need your input ! Many good
things come out of when people get angry and mad because now it is in
their face and they are committed to thinking about it, where as
before it was just something they never really seriously thought about
and learned to live with on a daily basics. I'am looking for people to
talk about it so together we can find new ideas, through ongoing
dialogue, that might help our political representatives make new changes
in the old 1970's Rockefeller Drug Law/s. We need new solutions and methods of handling our
inner city problem/s in a world that has out grown outdated 1970 drug laws, rules
and regulations, that is what I'am after. I
have seen the imprisonment of thousands of young African and Hispanic
Men and Women warehoused like caged wild animals in cargo storage containers
and many were not hard core criminals and when released from jail are placed on parole.
Some are already educated but most come out of jail the same way they
went in, uneducated and not properly trained before they
return home. Most will not receive the help they need in jail and one slip up
when they are back on
the streets, lets say caught with one or more bag/s of reefer in their pockets.
Will return
them back to jail
renewing the cycle of becoming locked up all over again and tearing
apart numerous families at the same time and the core of our communities. Many of the youth today
do not get high, some smoke
reefer and drink beer compared to the older generation which chooses to
drink more wine and alcohol brought from Liquor stores then the youth do. Many
liquor stores have seen a small decrease due to the shift of older
people that drink dying off but are still
able to stay in business.

I find it
absurd when a parent is telling his or her child to stay away from drugs
and they have an entire bar in the basement or living room stocked with
wine and liquor. Also when you open the refrigerator you may see one or
two quarts of beer or wine. After work or on weekends not everyone but
alot of people come home and will sit in front of the TV or on the sofa
drinking beer, wine, or alcohol in front of the kids
steadily saying to their
child. You should stay away from drugs and don't get high when the
parent is really expressing to them in a weird way, "do as I say and not as I do",
when the parent is really expressing in a strange way to them ? I
like getting high, but you should not experience what I like to do !
Let's face it both drugs, beer, alcohol, reefer, dope, certain pills,
LSD, uppers, downers, cocaine and wine are
all mind altering substances. You can't really blame anyone for trying to
feel good in life or want a taste of the good life when everything in their life is
falling down around them [This is not an endorsement of drugs ] no matter how hard they try but no one should
even think about getting high at all in the first place. Back in the 1970's
I personally knew many people enrolled in college who were concerned
about their education, who would party on the weekends smoking reefer,
sniffing cocaine or what ever to loosen up
after having a hard week of studying or even going to work. I grew up
during through the 1970's when the drug problems started during the

Drugs started out similar to how a person would drink a beer or
pour a glass of alcohol today it was placed into our community purposely
to help degrade and mislead the so called minority population. But the
people that placed drugs within our communities never thought that it
would bite them back in the butt by invading their own communities. Now, I do not condone taking any mind altering
substances or drugs but feel ? It must be the word called "DRUGS ITSELF " that is
the true criminal ! It seams to bring out negative connotations when
most people hear it and most people
have connected the word '"DRUGS" so long to bad things, that they totally forget about
the fact that legal beer, wine and alcohol accomplish the same thing and are
no different from reefer smokers, cocaine and dope sniffers by just wanting
to feel good, relax and enjoy life.

I have seen many college student lives ruined just
because they were caught with a bag of reefer in their pocket and were thrown out
of school and some had to do jail time on top of it all for what, when the same police
officer, chief or sheriff that might have arrested them. Might be going home to
open up a bottle of beer or sip on his favorite wine or brandy, none of this makes
any sense to me. I have seen hundreds of young lives ruined because of
these double standards, speaking with a fork tongue The Native American
[Indians] would say and I think its time to admit that the majority
of people that are coming out on the wrong end of the stick more than
anyone else are the so-called minorities, young African
and Hispanic Americans.

I have seen so many young lives cut short who
were trying to do the right thing, meant well and who were just hanging
out and having some fun with their friends just like you would drink a
beer or sip on a glass of wine or alcohol brandy which no one should ever do
because getting high is a complete waste of time and money. When ever a young
adult would get
busted and go to jail, yes they were nieve young adults and after one or
more year's of
being in jail with major professional criminals, basically for minor crimes.
They have now entered the PHD
Criminal College called The Penal Institution, graduated with a PHD in criminality and
some have
moved up into becoming
professional criminals in life forever all because they were locked up for a bag
of dope, cocaine or reefer which they should have never used and should
have been given a fine for violating the law because they are not drug
dealers as the law states when they are caught with one one bag of drugs
than the law allows. Now that they are considered profession criminals
and have graduated from a PHD criminal college and have
truly learned all of the new slick illegal ways of making big money,
which they might not have
never been exposed to before. Now that they have learned a new career because they were
busted and thrown in jail for one bag of reefer or having a small portion
of dope or
cocaine in their pocket/s.
They have grown up in jail and are not scared of going back into
jail anymore some then start to see going to jail as part of their life and many say they
are still angry at society for what they did to them all because they were trying to do right thing by
going to school and just wanted to blow off some steam and have some fun.
But after being thrown in jail and crying all night for
weeks/months ? They have no more tears to cry for themselves or anyone else and
now do not care what happens to themselves or anyone else anymore. Look at the
non violent man or women that has now turned into a violent monster that we
in society have now created. What I have written in words happens hundreds
of times across our NYC five boroughs and across the country, not to everyone but it does happen in the
inner cities across America everyday. If a person was
trying to do the right thing in life by going to school and holding down
a small job. Once thrown in jail and now on parole how would you feel
and react if you were in their shoes or if your son or daughter got
caught up in the penal system ? You would feel "BETRAYED" and
possibly ? " WANT REVENGE" ! This is how many of today's kids feel, I know I talk to them
on the streets directly ask them their opinions and realized we have been brain washed
and the real crime is keeping drugs illegal in the inner city ! If you do not want to
organize the kaus or legalize drugs in the inner city areas, what is the answer
? Many would say, those drug fiends they rob and kill people, they steal and
break into homes. If their was no such thing as drugs certain people
would still rob, steal and kill people just because they think they could get away with
it and they look at it as a game in life "like its - me against them" ! In China if
caught selling drugs they shoot you after a trial, everyone over their knows this but
their are still hundreds of people each year still willing to sell drugs
for the money, just because of the money the excitement, to show others that it can be done and
that they can get away with it until they get caught and say " I did not
know what I was doing, hey give me one more chance " come on !

Many church preachers would say
legalizing drugs would turn this place into hell," Knock, Knock" HELLO ?
Who's to say where in space and time we really are ? Can anyone prove to
me that the planet we all know in space called earth is not really
called " HELL" anyway ? Who can logically say where we are in space and the
moments we adorn in time, no one has come back from the dead I know to
truly say where we are in space and time that I know of ! You know we could be living inside of a cardboard box
filled with thousands of holes punched into it that look like stars in
the sky because they are so far away and the owner of the box
could, just change the light around the box we live in on a daily basics to
present day or nighttime to us. Or
we might have all died in another life before and our spirit landed here on
what we all know as, " good old " Mother Earth " and this
place might really be " HELL " !!

Our USA prison corrections system
is a joke why ? Just look at the word corrections why is it even
utilized when most of the prisoners I see that return out of jail
system increase their illegal activity almost immediately mainly because
of their GPS computerized parole record. Like so many prisons around the world
the majority of them were not setup to train or educate
anyone? They were setup to "warehouse and punish people " and that is their chief
function. Prisons we must have, because their are crazy people and some people who always
look for the short cuts and who will continue to repeat the criminal process after
being released from jail and their goal unknowingly is to become a career
professional criminal or be locked up
once again. Most prisoners
do time, instead of making time work for them in their favor. Learning a
skill in jail is better than calling your self slick and learning more
illegal tricks that will definitely place you back in jail somewhere in
the near future. I truly feel that the time has come to for us to take
another look at allowing drugs,
reefer, and other illegal mind altering substances and make them
legal with stick rules and regulations. No one should take drugs but
people will do what they want to do even doe you preach that they should
not take any drugs. Why legalize it, we could make the consumers carry
ID for it, make the age limit 21 year's old and have pictures taken of
them so if they do go out and steal the police could find them quicker.
You will say " legalize drugs " NO WAY " but do you have a better answer
that will protect citizens that do not want it around at all ? How do we
stop it or should we institute new ways of regulating it, what is the
answer. The system we have now does not work so how should we fix it. We
should not even be talking about legalizing drugs but then how can we
reform what is happening on our inner city streets. Most rural areas do
not have the problems that urban inner cities experience and that is why
I feel we must find new ways of reforming what is going on because it is
not going to go away. Thousands of families
life's have been ruined, and their are thousands of innocent people going to
jail for minor offenses. Alcohol and beer are legal mind altering
substances true and no one is going to jail ? Then why should you lock up anyone who is only hurting themselves.
Most people after using drugs for year's grow out of using them entirely
as they mature, grow older and realize that it was just a huge waste of
time using them in the first place and are telling the kids about it. The
USA is on the path of going broke and their is nothing else on this
planet that makes
more money or allows you to accumulate money faster than selling drugs. Drugs
out sells cars, boats, houses, airplane tickets, stocks, future
commodities and many fortune 500 companies listed on the stock
market exchange and has created its own sub-culture that will never die. Many of
today's top prominent doctors, lawyers, political, movie stars, musicians,
hip hop rappers, football, basketball, baseball, soccer players and many blue
collar workers utilize it on a daily basics, keep it under cover, will
risk getting caught and going to jail on a daily basics just to feed
their need by any means necessary ! It is ridicules to think that any
law in the land can stop any person from doing what they have made up
their mind to do. If the USA was to go totally broke
and sold off in pieces to China or some other foreign country with out
us first legalizing drugs to boost our economy and paying off the dept we owe ? Many people in hind
sight would
then say ? I can't stand what I'am thinking but, I think we should have legalized drugs, just to get enough money so the
USA would not have to be sold off in pieces to investors, the highest
bidder, or as a whole to other
foreign countries then people would say to others in hind sight. Yes I
now feel, even doe it is to late that, I think we should have legalized drugs
because the war on drugs never worked efficiently anyway, and yes it was definitely a foolish law
because it could have changed things within our country dramatically then
we would not have become citizens of The U.S.S.R or any other country
that would have taken over The USA.
They would go on to say, look at the freedom we lost and the deplorable
way we are now living, if I could only turn back the hands of time. Wouldn't it be foolish if we did not legalize drugs
to pay off our USA debt to foreign country investors and do everything within our power today
to keep The USA free, strong, independent on its own, and prosperous
even doe we did something we deep down inside feel was morally wrong ?
If drugs were legal the gained tax money could be used for positive
things just like the government uses the tax money they get from the
sales of cigarettes and alcohol. We would all feel very stupid in the
future after the ink was dry on the USA legal foreclosure sale papers in
hind sight say ? We made a big " BO, BOO " ! We are at the perfect
moment in time to line up and catch the sands of time in our hands before they fall
to the bottom of the hour glass. The time is right and we should look at changing the law/s, right
now, changing the drug laws will not make the world any better but it
would change alot of the double standards that we see today and keep
drugs away and out of the hands of 8, 9, and 10 year old kids who can
buy them any time they want from street corner drug dealers ? The USA currently reminds me of a person on a street
corner trying to borrow money from anyone that passes shaking a tin cup
in hand that has 50 cents in coins making noise as the coins slide back and
forth and roll around within the tin cup making noise as the owner says
"Hey brother can you spare a dime" !

Their are no easy answers when
society improvement changes knocks at your door and
yes keeping your respect and pride is everything when you are down on
your luck. Keeping your pride is the foundation one stands upon to pick
themselves back up off the floor and move out of the gutter when you fall or fail
taking drugs only makes your dreams like a star in the sky, meaning its
harder to reach. Right now
the USA has to keep borrowing money from other foreign countries and
investors while printing money as fast as we can without having the gold
deposited in a bank vault and all the while still hanging out on
the street corner shaking the
tin cup for more money in hand makes us look really, really badd ! Yes Their are no
easy answers and legalizing drugs would not solve all of our earthly USA
problems, but it would organize the current mayhem on our inner city
streets and yes their will be other unforseen problems that will occur
but a change is still needed. If you do not like what you are reading
about then what are your suggestions about a topic that is not going to
go away tomorrow, what would you suggest I would really like to hear
your suggestions. I have talked to thousands of kids throughout my lifetime that
live within Brooklyn N.Y and throughout the five boroughs of NYC and
when the war on drugs started first felt drugs should stay illegal. But
like protesting Aids and giving needles to addicted coke and dope fiends
on the street to prevent the spread of aids, and like the free
dispensing of condoms throughout the world to slow the spread of Aids. The government
first felt insulted, then slowly came to the realization that the USA
would be better off and then finally settled down and really listened to
the peoples out cry and made the right choice. Giving needles to
addicted coke and dope fiends and giving out condoms for free on the
street its time had come of age to prevent the spread of the HIV/AIDS
Virus.

I have
come to realize and as time slowly revealed the answers to me.
Legalizing drugs would solve alot of our USA immediate and long term
economic debt, tax, unemployment, economic growth, and money raising
problems. It would also take the money off the streets so drug dealers
could not make a living from the money they earned and stop alot of the "senseless killings" by street
corner drug dealing gangs fighting against each other. I hope the new
laws would stop the senseless killings of
innocent people during gang raids against other drug gangs as they shoot
bullets when they take the time to individually shoot at someone or do a
local drive by shooting. Like smoking
cigarettes the new laws would make it harder for under age kids and upcoming
teenage drug addicts to get drugs without an ID when they buy it in the
store as their names are logged into a computer with their picture, and it would place our
communities back on a positive path keeping families together. It would
also stop the new young teenage drug dealers from jumping into the guys
place who just got busted during that morning. If the government does
not want to legalize drugs, then hopefully it would allow law
enforcement to give out fines for possession. Legalization would
hopefully stop the drive by
shootings of drug dealing gangs trying to take over another's territory, force
most revolving door inmates to learn a real trade, become educated and have renewed
hope and a real positive chance of integrating back into society because
they cannot make any money on the streets or deal out of high class
suburban homes anymore. But most of all the
government would get a unique stream of continuous year round tax money that could possibly triple the amount of tax money they get
now from selling
alcohol and beer all together.
With
The New Influx Of Money The Government Could
Jump
start the economy,
Stop
begging foreign countries for money,
Throw the tin cup and dark
sunglasses away and stop begging on street corners altogether,
The Government would regain
USA respect, pride and nobility in the world,
Be
able to give local state governments more money for new community
educational, recreational, cultural and any other positive program/s
for our communities growth,
Totally sponsor the green energy
initiatives across the country,
Keep
oil prices stable for year's to come with guaranteed subsidies.
Increase credit to the banking
system,
Subsidize employment wages
Start new transportation
improvements across the country which increases new jobs,
Start new interior capitol
improvement construction
programs across the country which will create new jobs,
Provide more free money for college education and
tuition,
Possibly give free medical to all Americans,
Make sure that Social Security has enough money in
the bank when you retire,
Provide more money to
keep Bus and Train fares stable
And have
a constant year round stream of high income on the side to begin the rebuilding of America
Pay off China and other foreign
countries that the USA owes and boldly say to them. "

Remember the first bad example was set way back in the 1940's when the
government first legalized liquor it has now become a way of life that
prominent high society and blue collar Americans enjoy 24/7. I feel we
are living in the days of
drug probation similar to how alcohol was first seen before it was legalized
back in the 1930's and 40's.
When people want to get high it is something they are going to do
whether it becomes legal or not. Remember it is a personal preference,
something you can not stop no matter what you do or think, even locking up
people will not stop it. The War On Drugs is one of the biggest jokes in America today
making like locking up people will solve the problem and totally stop the
plague from growing. The only way to stop it is to stop the people that
manufacture it which the government can or will not do. After
38 year's the drug war has not worked and keeping it operating is as
ridicules as seeing a pink elephant flying around through the air with wings
called the pink dumbo drug laws !

It is stupid to keep a blind eye and
really foolish to try and act like the war on drugs is working when
everyone knows that it is one of the biggest and one of the longest
running jokes within the inner cities of the USA across America. The only reason the so called drug war is
kept going is because it is a USA money maker for the entire legal system
across the country from the court lawyers, the judges on the bench, the
court house security teams, the jail house correction officers, the
district attorneys, the
local and city police departments across the country, the towns in which the prisons
reside reap the benefits while local business that feed off the crumbs left behind
from broken dreams and tears of prisoners oils a system that feeds upon USA citizens abused legal rights
and has inadvertently created a new form of legal slavery within our
society.

The world
is a very stressful place, and when people get off of work they
like to let their hair down, relax, celebrate and cool or chill out. Most like to prolong
their sexual experience with drugs, while others like to drink the
finest brandy, sniff the finest cocaine, drink wine, smoke the most potent reefer,
while others will drink a 40 ounce or beer or smoke crack cocaine to
achieve their sexual utopia that is the real world we live in. I do not condone getting high,
and no one should ever get high on drugs or alcohol ever, but you got
to remember alcohol and beer stimulates the same brain receptors that
reefer, cocaine, crack, wine and dope does, it makes a person "feel good" that is
why they do it. I do not knock anyone when it comes down to enjoying
themselves after all, if they are adults they can buy anything on the
planet with their own money and do what they want, "right" !

You would think only young adults over the age of 17 and up would
indulge but their are minors ages 8 years and up that drink alcohol and
beer, sniff dope, coke, and smoke reefer just as much as the adults do
now.
I do not like or condone this behavior but, you got to remember kids and
teenagers like to immulate the adults they see and by hook or crook
when someone has their mind made up and they want to obtain an illegal
substance? Their is nothing in this world that is going to stop them from getting it
or talk them out of it.
By legalizing drugs the government would benefit from the tax money, it
is not the cure all answer to all of our problems on earth it would just
organize and have the police keep tabs on the users in a better way
without harassing and busting all of the people that do not take drugs.
My solution will not make the world a better place the but it surely will
help stop the arrest of innocent people and with ID's the Police could
catch those addicted addicts that rob and steal quicker. Many will say
he is crazy but do you have a better answer I'am willing to listen.
After 38 year's of a broken drug law system that does not work, what is
the answer. It's strange I wrote this news article back in December 2008
and in January 2009 NYS Governor David Patterson on his own said we must
take another look at and change the old " 1970 Rockefeller Drug Laws " !
Some how he must have seen or been dreaming the same dream that I saw at
the same time. I was stunned when he said it and always felt that our
NYS drug problem seams like it will never totally go away so what is the
next best thing ? I feel the next step is for NYC residents to think and
talk about how we can improve our quality of life. When ever you sit
down with your friends talk about it, talk about what you would want to
change and help come up with a new solution that we all could live with.
I really hate thinking about legalizing drugs but what is the answer
surely you have some good suggestions, so lets hear them go to our forum
and leave your thoughts behind. Legalizing drugs will not cure all of
our problems but organizing the drug problems that are now going on
throughout America within our inner cities needs to be looked. We must
find a better way of dealing with a broken legal system that is
inadvertently has created legal slavery, we have a system that needs new
creative ideas and demands immediate attention to solve an on going
problem that will not go away. I know of no financial business plan
that could currently help the USA accumulate
huge amounts of money in a short amount of time other than the legal
sale of drugs, do you know any ? Plus this financial plan may not be
popular but it sure will help America collect alot of tax money and
place the USA back on top quicker,
create more jobs and open up more new business faster than anything else
that I currently know of on this earth ! Talk about it with your friends or

feel the time has come to recognize that we are only hurting our selves
by not doing it immediately because the use of drugs will not go away
without us destroying the source that grows the farm crops. In the third
world reefer, cocaine and dope are high paying cash crops that the
farmers say can not be replaced. Other cash crops that farmers grow in
their country do not pay as much and farmers see growing coco leaves and
reefer and other drug crops as a way to feed their families. With that
type of thinking, how should we in the USA deal with a drug plague that
for over 38 year's has not decrease. I hate to see kids taking drugs and
tell them all the time " Do Not Take Any Drugs " ! But I also have the
common sense to know that our societies on going drug problem within the
USA is not going away anytime soon that is reality. We need to relook at
finding new ways of dealing with a hard subject to swallow so our
countries drug problems and citizens can safely walk the streets.
Organizing and taking the money off the street can only improve the
quality of their life, yes dealing with the problem is distasteful but
watching our legal system operate in a disfunctional manner by abusing
residents rights for over 38 year's is even worst. The drug laws should
be updated to reflect today's inner city community needs as the sands of
time slip through the hour glass and at the same time help educate
others about the perils of using drugs and what can happen to them in
the future. The USA has a major drug problem nobody wants to talk about,
I feel it is better to have the k-ous we all now know today better
organized because it is not going away. The street corner drug dealing
locations would be gone and either ran or over seen by the government
regulators or have private contractors own and operate legal store
locations to take the money off the streets and away from illegal drug
dealers who sell to under age kids. What I'am saying is un-tastefull but
it is a better way of dealing with our current inner city drug problem
on the street compared to the way we are dealing with it now while still
educating the public about not to use drugs similar to how mothers
against drunk driving has their on going campaign. Only then do we have
a real chance at changing things and ending the new legal slavery
criminal justice system that has evolved through the NYS Rockefeller and
other USA outdated antique Drug Laws.
In New York, a person must prove two
main issues in any car accident claim. Most attorneys and insurance
adjusters call these two issues "liability" and "damages."
Liability, or who was at fault; and the damages or amount of the
loss; are the two most important factors in evaluating a potential
auto case. The person must show that another party was negligent in
the operation of their motor vehicle. Negligence is generally
defined as a "failure to use reasonable care". In New York you must
show that the damages you have sustained are great enough to meet
the statutory requirements outlined below.
New
York Threshold for Damages
The New York legislature enacted a No
Fault statute in an attempt to control the amount of automobile
crash lawsuits. According to that statute, you may only sue another
driver for negligence for personal injuries suffered in a car
accident when your expenses are in excess of $50,000 or when you
have sustained "serious injury". The New York state legislature
defines "serious injury" as a personal injury that results in any
one of the following:
1. Death;
2. Dismemberment;
3. Significant disfigurement;
4. A fracture, Broken Bone;
5. Loss of a fetus, unborn child
6. Permanent loss of use of a body organ, member, function or
system;
7. Permanent consequential limitation of use of a body organ or
member;
8. Significant limitation of use of a body function or system;
9. Or a medically determined injury or impairment of a non-permanent
nature which prevents the injured person from performing
substantially all of the material acts which constitute such
person`s usual and customary daily activities for not less than
ninety days during the one hundred eighty days immediately following
the occurrence of the injury or impairment.
Comment:As you
can see from the terminology used in the statute, it is difficult to
determine whether your injuries may fall within one of the specified
sections above. While items one (1) through (5) are easily defined,
items six (6) through (9) are very ambiguous. Typically, much
litigation in New York Automobile liability cases revolves around
what are referred to as "threshold" cases. In other words, attorneys
and insurance companies will evaluate your case depending upon
whether you have met the "threshold" requirement of a "serious
injury" as defined by the New York statute.
Have I sustained a "serious
injury" under NY Law or not?
The answers to this and other
questions are even more complicated than they seem. Because the
legislature has left all these terms in such an ambiguous state, the
Courts have attempted to define all these terms through what is
referred to as "case law" or judicial rulings. In other words, your
attorney might be able to find a case that shows that because you
missed work for more than eighty days, you have sustained a "serious
injury"; or a case that shows that when you fractured or dislocated
your shoulder and were diagnosed with a permanent loss in its range
of motion, that your injury meets the "threshold".
Much of the analysis focuses around
your medical diagnosis. An attorney will typically request an
affidavit from a doctor or present your medical records in order to
prove that you have sustained a "serious injury". Your case,
however, will require a complicated legal argument. In these types
of cases, you should always refer to an attorney in order to
determine whether your claim is worth pursuing.
"Basic
Economic Loss" Under New York Law
You cannot sue another driver for
personal injuries suffered as the result of a car accident for what
is referred to as "basic economic loss". The New York legislature
defines the term "basic economic loss" as damages sustained in an
amount less than $50,000 per person, per accident.
The following expenses may be used in
determining whether you have sustained "basic economic loss" or
expenses in an amount less than $50,000:
1. All necessary expenses incurred
for: (i) medical, hospital, surgical, nursing, dental, ambulance,
x-ray, prescription drug and prosthetic services; (ii) psychiatric,
physical and occupational therapy and rehabilitation; (iii) any
non-medical remedial care and treatment rendered in accordance with
a religious method of healing recognized by the laws of this state;
and (iv) any other professional health services; all without
limitation as to time, provided that within one year after the date
of the accident causing the injury it is ascertainable that further
expenses may be incurred as a result of the injury.
2. Loss of earnings from work which
the person would have performed had he not been injured, and
reasonable and necessary expenses incurred by such person in
obtaining services in lieu of those that he would have performed for
income, up to two thousand dollars per month for not more than three
years from the date of the accident causing the injury.
3. An employee who is entitled to
receive monetary payments, pursuant to statute or contract with the
employer, or who receives voluntary monetary benefits paid for by
the employer, by reason of the employee`s inability to work because
of personal injury arising out of the use or operation of a motor
vehicle, is not entitled to receive first party benefits for "loss
of earnings from work" to the extent that such monetary payments or
benefits from the employer do not result in the employee suffering a
reduction in income or a reduction in the employee`s level of future
benefits arising from a subsequent illness or injury.
4. All other reasonable and necessary
expenses incurred, up to twenty-five dollars per day for not more
than one year from the date of the accident causing the injury.
So, you may still have a case if you
can show that the expenses as defined above exceed the amount of
$50,000.
NY Law:
Summary
In summary, following an accident, you
may review one of the clearly defined subsections above to determine
if you have sustained a "serious injury". If you or your family
member has not suffered one of the clearly defined injuries (ie.
death; dismemberment; significant disfigurement; a fracture; or loss
of a fetus), you should consult an attorney who will be able to
determine whether your injuries may fall within on of the other
categories of "serious injury" above. If you have not sustained a
"serious injury' in any of these categories, you may still have a
case if you can show expenses or the potential for expenses to
exceed $50,000. Either way, always consult an attorney who will be
able to protect and enforce your legal rights.
Finally, you should be advised that
you may not be entitled to pursue any action if you are subject to
any of the following:
1. Intentionally causing your own
injury;
2. Operating a motor vehicle while in
an intoxicated condition or while your ability to operate such
vehicle is impaired by the use of a drug within the meaning of
section eleven hundred ninety-two of the vehicle and traffic law;
3. Are injured while: (i) committing
an act which would constitute a felony, or seeking to avoid lawful
apprehension or arrest by a law enforcement officer, or (ii)
operating a motor vehicle in a race or speed test, or (iii)
operating or occupying a motor vehicle known to him to be stolen, or
(iv) operating or occupying any motor vehicle owned by such injured
person with respect to which the coverage required by subsection (a)
hereof is not in effect, or (v) a pedestrian, through being struck
by any motor vehicle owned by such injured pedestrian with respect
to which the coverage required by subsection (a) hereof is not in
effect, or (vi) repairing, servicing or otherwise maintaining a
motor vehicle if such conduct is within the course of a business of
repairing, servicing or otherwise maintaining a motor vehicle and
the injury occurs on the business premises.
The state of New York is very strict about enforcing these laws. As
such, you may not have a case if any of the above circumstances
apply to you.
This is
true. Living in Florida they already know not to save bottled

Johns Hopkins has recently sent this out in its newsletters.
1. No plastic containers in microwave.
2. No water bottles in freezer.
3. No plastic wrap in microwave.
This information is being circulated at Walter Reed Army Medical Center as
well.
Dioxins are highly poisonous to the cells of our bodies. Dioxin
chemicals causes cancer, especially breast cancer.
Don't freeze your plastic bottles with water in them as this releases
dioxins from the plastic.
Recently, Dr.. Recently, Dr. Edward Fujimoto, Wellness Program
Manager at Castle Hospital, was on a TV program to explain this health
hazard. He talked about dioxins and how bad they are for us.
He said that we should not be heating our food in the microwave using
plastic containers. This especially applies to foods that contain fat.
He said that the combination of fat, high heat, and plastics releases
dioxin into the food and ultimately into the cells of the body.
Instead, he recommends using glass, such as Corning Ware, Pyrex or
ceramic containers for heating food. You get the same results, only
without the dioxin. So such things as TV dinners, instant ramen and
soups, etc., should be removed from the container and heated in
something else. Paper isn't bad but you don't know what is in the paper.
It's just safer to use tempered glass, Corning Ware, etc.
He reminded us that a while ago some of the fast food restaurants
moved away from the foam containers to paper. The dioxin problem is one
of the reasons.
Also, he pointed out that plastic wrap, such as Saran, is just as
dangerous when placed over foods to be cooked in the microwave. As the
food is nuked, the high heat causes poisonous toxins to actually melt
out of the plastic wrap and drip into the food.
Cover food with a paper towel instead.

Due to the NYC Council having program funding problems we were not able
to provide our summer 2008 games. This is the first time in the 34 year
history of us sponsoring The HUDSONIC ORG SHOWSTOPPER BASKETBALL SUMMER
TOURNAMENTS that we did not have the games operating due to missing our gym
scheduled date due to The NYC Councils money problems. Their was a huge
amount of programs inside of NYC that faced the same problem we faced. Mainly because
when you schedule a gym facility and you can not provide the program service during
the time you scheduled it then ? Life goes on and another program has to be
substituted in place of your program in order to fill the allotted time
period that
you were supposed to be utilizing. We want all of the teams and coaches to
know that what happened was definitely in Gods hands and out of our control.
